Terms of service

These terms are the agreement between you and Samgar Abdikozha, a sole proprietor doing business as FirstReplyPro ("FirstReplyPro", "we") covering your use of the FirstReplyPro service. By connecting a Thumbtack account to FirstReplyPro, you accept them.

What the service does

FirstReplyPro connects to your Thumbtack account with your permission and, where you have enabled it, sends a first reply into that conversation on your behalf. Messages we send appear to the customer as coming from you, because they do.

Eligibility

You must be 18 or older and authorised to act for the business whose Thumbtack account you connect. You are responsible for keeping your Thumbtack login credentials secure.

To stop the pilot, contact the operator at support@firstreplypro.com. The operator will disable the service and remove its stored tokens. You can also revoke access through Thumbtack where that option is available.

Messages sent on your behalf

You remain responsible for every message sent from your account, including automated ones. When enabled, the pilot uses Anthropic AI to review the available lead information and conversation and automatically send one first reply without individual message approval. The business owner approves the response instructions before activation. The reply asks for a convenient time and job address only when they are missing; it must not invent prices, availability, or booking confirmations. We are not a party to your agreement with any customer, and we do not guarantee the accuracy of an automated reply — do not enable automation for quotes, prices or commitments you are not willing to stand behind.

Acceptable use

You agree not to use FirstReplyPro to send unsolicited marketing, to misrepresent who you are, to harass anyone, or in any way that breaches Thumbtack's own terms. You agree not to connect a Thumbtack account you do not control, and not to attempt to access another user's data.

Thumbtack

FirstReplyPro is an independent product. It is not affiliated with, endorsed by, or operated by Thumbtack, Inc. We depend on access that Thumbtack grants, and if that access changes or ends, parts of the service may stop working. Your relationship with Thumbtack — including what you pay them for leads — is entirely between you and them.

Fees

FirstReplyPro is currently provided free of charge. If we introduce paid plans, we will tell you the price by email at least 30 days in advance, and we will not charge you unless you explicitly agree.

Availability

We aim to keep the service running continuously but we do not promise uninterrupted availability. We may take the service down for maintenance, and outages at Thumbtack or at our providers are outside our control.

Your data

You keep all rights in your business data and in your customers' data. You grant us only the permission needed to operate the service for you. Our handling of personal data is described in the privacy policy, which forms part of these terms.

Disclaimer and liability

The service is provided "as is". We do not warrant that it will win you work, that any particular lead will convert, or that every message will be delivered. To the maximum extent permitted by law, our total liability to you for any claim arising out of these terms is limited to the amount you paid us in the three months before the claim arose. We are not liable for lost profits, lost business or lost leads.

Suspension and termination

You may stop using the service at any time by contacting support@firstreplypro.com. We may suspend or end the service for a connected Thumbtack account that breaches these terms, that we are required to close by Thumbtack or by law, or that is being used in a way that puts other users at risk. Where we can, we will tell you first and give you a chance to fix the problem.

Changes to these terms

We may update these terms. If a change materially affects your rights, we will email you at least 14 days before it takes effect. Continuing to use the service after that means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Florida, United States, and any dispute will be heard in the state or federal courts located in St. Johns County, Florida.
